Way off topic, but you, SCC, and your fellow officers need to look into this. It appears that the State's Attorney has issued a directive to her assistants that if a judge makes a finding in open court that a police officer's testimony is incredible (not credible), they are to notify their supervisor, obtain a transcript of that ruling and, along with copies of the police reports and other relevant material, give that material to the superivisor. Apparently, the State's Attorney will be maintaining a bank of such rulings and then when that officer has to testify in other cases, a copy of such (a) transcript(s) is (are) to be tendered to the defendant's attorney in each subsequent case(s).
I would suggest that you and the FOP look into this ASAP. The consequences in such a narrative are dire and immense.
We remembered it because this caught our attention - this one appeared in a post Tuesday:

- have you ever been arrested and, if so, did you plea guilty, found guilty or found innocent
- have you ever been considered untrustworthy in court.
Supposedly this is new and will happen in the jury room. FOP??? Will we be able to refuse to answer these ridiculous questions? If you are doing any form of proactive police work, you’re crazy. If this is true and comes to fruition, you’d have to be reckless to do anything other than show up and drive around aimlessly.
So the State's Attorney is now acting as defense counsel? Because just about all of that is irrelevant, and on the off chance it gets admitted, it's in any number of databases that Corp Counsel maintains. In fact, Corp Counsel has been sanctioned for keeping it secret in a few civil suits recently.
Anyone want to clue in the readers? It certainly looks like they want to Rule 14 as many cops as they can for whatever they can dredge up.

Anyone doing any proactive police work you need your head examined.
Let's add this all up and consider if any proactive policing makes sense in this environment:
1. The Cook County State's Attorney, Kim Foxx, has no interest in putting anyone in jail, unless they are police officers. Her barriers against prosecution are breathtaking.
2. The Cook County Board President, Kim's political master, is absolutely opposed to "men of color" being put in jail. This despite the fact that the overwhelming amount of violent crime and property crime is committed by this same group. This is not meant as a racist statement. It is simply an incontrovertible and long held fact, which can be corrected only by those committing the crimes.
3. The Cook County Sheriff, Tom Dart, was Never a law enforcement officer. He is a political creature through and through and his read of the political tea leaves tells him to keep the jails empty. Fewer prisoners ("clients" in his world) means fewer problems and more votes - fuck the safety to the public. He doesn't care because he doesn't believe any of it will be pinned on him.
4. Mayor Rahm. Seven years ago he was the darling of the press and thought this was a short stepping stone to much higher office, perhaps even the Presidency. Today, major national democrats are either hostile toward him or simply avoid him altogether (Consider both Clintons in town for an event at Navy Pier last month, where they snubbed the mayor). He has fundamentally and irrevocably destroyed the functional operational capabilities of the Chicago Police Department. His offenses are too many to state but well known by our readers. However, remember this point - He Reappointed Lori Lightfoot, AFTER she authored a report on the CPD in which she stated we are a Fundamentally Racist Organization. He didn't care that she libeled our department and all of us with such hateful language. He reappointed her because he thought doing so would help placate the black community, as he has done with all of his decisions. He also thought he was keeping her close to keep her from running against him or opposing him. What sweet poetry it is to see her run - so long of course, as she doesn't win. Rham is the central architect of all the civil, criminal, political and social liability we all face when we go to work.
As a career police officer that has taken pride in being an aggressive officer who associated with the kind of officers that I wanted to become, it is troubling to see all of this. Nonetheless, please consider these facts and ask yourself what the risks and rewards are.
So the best route to take is, do not take any law enforcement action that leads to going to court where they will impeach you with a "legal colonoscopy."

If you are doing anything more than signed complaints attests you need to have your head examined. They will hang you without a care in the world. 4) If an officer is compelled to answer these questions, what is the FOP, Sgts. association(s) doing to protect their members?
Refuse to answer these questions. The ASAs are not even asking their civilian witnesses these types of questions, just the police. Please remember any answers you give to an ASA that is documented is then available to anyone through a FOIA request. Be smart and take care of your best interests.

An officer’s believe-ability is always relevant and although may not be directly relevant (such as a divorce) it may lead to information that could uncover relevant information which is allowed under civil discovery rules. This is nothing new. The State Attorney’s Office has always kept computer records/ databases on officers and detectives. It is almost as bad as a street file. When an officer or detective call in a case to be reviewed they are asked “What is your callback number?” “What is your star number?” “What is the offender’s IR#?” The ASA supervisors review previous notes written by other State Attorney’s and then determined if they will send out a tougher State Attorney or a newer one. They review the officer’s history as well as the offender’s background.
If an officer or detective is known for shady or incomplete investigations the responding State Attorney will scrutinize their investigation and do everything in their power to reject or CI their future cases. State Attorney’s has a list of reasons to CI an investigation.
Have you ever wondered why the responding State Attorney’s ask officers to step out of the interview room so that they can speak with the offender privately? Have you ever wondered why they ask the offender “How were you treated by the officers“ , “Were you allowed bathroom breaks”, “ Were you allowed to eat?” They also ask similar questions during victim/witness interviews.
If you find that a State Attorney is rude to you the moment they arrive, then you are probably on the shady list.

As has been stated earlier in the comments, this is nothing new. As a retired Fed, I can tell you that it's long been the law of the land that a prosecutor is REQUIRED to turn over to the defense any substantiated finding that an LEO was ever found to be "less than truthful". This could apply to voucher fraud, lying in a divorce proceeding, or certainly having a Federal judge determine that your testimony in prior case was intentionally deceptive. The bad thing is, there is no statute of limitations on these types of findings. I know many Feds who could no longer testify in court (because of an old "Giglio" finding) and they are forever tainted from being used as credible affiants or witnesses in court. But again, this is something to discuss with the ASA. Not everything fall into this category and a good ASA will fight for the officer to keep him from being 'tainted'.
Whelp this is one way to resolve the pension crisis!

Can one plead the 5th, even though you’re not the “accused?” That line of questioning appears to accusatory in nature, of not entrapment.
I think they are just protecting themselves from what the defense attorneys are going to do otherwise.
If a judge finds a person's testimony is not credible that is a huge deal and makes anything he/she has ever testified to, or will testify to, suspect. Better to know about it up front.
Ethically and by rule, the SA is actually required to represent the people, not just do their best to get a guilty verdict. It is the same reason they are required to turn over exculpatory evidence to the defense.
You do not have to answer any of these questions and I hope you do not. You only have to answer questions which are relevant to the case and questions when you are sworn on the stand. I will also implore you to answer "I do not remember" unless you are 100 percent sure as anyone that has read any literature or just gotten older can attest that like our bodies our memory tends to fail. I've been reading this outstanding blog for years now, and I constantly hear calls for the FOP to take action whenever something nefarious is being done to the rank and file such as this current asshattery. The FOP seems to be the correct organization to provide guidance and protection from this sort of abuse, but it seems to me that your current FOP "leadership" (and I use that term loosely) doesn't really seem interested in protecting coppers rights. If they were, they would be all over this and would have put out guidance on how to proceed if you find yourself in that situation at 26th Street. Maybe it's time to dump the FOP leaders and get someone in there who actually gives a shit about how coppers lives are being messed with. Personally, I find the constant calls for the FOP to step up rather demoralizing. They should be on the front lines fighting for your rights and looking out for you. It's a damn shame.
FYI- the Public Defender's office has been keeping a database for years on officers appearing and testifying in court. Style, weaknesses, background, complaints, etc. When one attorney subpoenas your background, it gets shared. If you're caught lying, it gets included.

SCC the ASAs are allowing officers to be impeached on the stand without intervention. Misstatements are being allowed to be admitted as lies because an ASA allows an officer to be impeached and all credibility to go down the drain. ASAs are not objecting or asking officers to clarify and are allowing defense attorneys to impeach officers on the stand for simple things that can be corrected by allowing an officer to review a report. The ASAs are not your friends. Most do not have any experience in a trial and stand no chance against most defense attorneys.
Personally I was grilled on the stand for over 45 minutes with no objection from the ASA handling my case. I used to be an attorney and know what tricks the defense was playing. They could not impeach me and could not get me to say what they wanted me to say. The judge had to intervene and ask if the defense was done asking the same question 100 times or if they were moving along with the case. The defense rested and the ASA did not ask me to clarify anything. The judge thanked me and I was done. Later the ASA tells me that I shouldn't have "annoyed the judge". I told her to f off and I walked out.
I'm seeing the same in all courts from the ASAs. They are not protecting their witnesses, the officers. The ASAs are not on your side.

I would refuse to answer unless ordered by a supervisor or a judge every single time. Also if a judge ruled you not to be truthful, call the fop and appeal it for a judicial review. The FOP has already had a few of these judges rulings overturned.

I would state that must be sought as discovery and that the witness (being you da poleece) has rights then i would only reply something to the effect of "sticking to the facts of the case at hand" etc and/or "i plead the 5th and seek advice of counsel not currently present and representation"
From my Fed Lawyer buddy....
Brady/Giglio lists are used to ascertain the credibility of any cops they want to use as witnesses at trial, or that are likely to be called as witnesses by the defendant.
Brady/Giglio material is evidence that the state has to disclose to the defendant either because it is exculpatory or because it is relevant to the defense in a material way.
The so-called "Brady/Giglio Lists" are usually lists of, let's say, sub-optimal incidences of lying or being disciplined for problematic conduct. Or, at least they used to be. If that cop was a witness, then the state had to disclose that "oh yeah, he was held in contempt for perjury in five cases," or whatever. But now my guess is that county prosecutors in places like Chicago use them as lists of cops who have ever been reprimanded for anything so they can look at the list, see that the cop was once warned for not wearing his seatbelt, and then decline to prosecute. Then they can blame the cop "because they had no credible witnesses." You're at war with your prosecutors, and this is their leverage.
So, in the real world, it's a list the prosecutor has to have to meet its discovery obligations in a criminal matter.
In Cook County, it's a blackmail and political device to fuck you guys over.

You do not have to answer any of these questions and I hope you do not. You only have to answer questions which are relevant to the case and questions when you are sworn on the stand. I will also implore you to answer "I do not remember" unless you are 100 percent sure as anyone that has read any literature or just gotten older can attest that like our bodies our memory tends to fail. This is true. They brought out a detectives past CR's before a jury trial. Who the fuck is on trial? The police or the defendant. Kim Foxx is dirty and needs to go. FOP needs to grow some balls and put an end to this practice.
The FOP refuse to insist that IAD stop releasing information regarding CR# that was closed more than five years ago. That information is on public sites as well.
