Low Charges

  • Chicago police say they found a stolen handgun, several magazines, and nearly 100 rounds of ammunition when they stopped a south suburban Lansing man near Clark and Elm streets.

    But, the Cook County State’s Attorney’s Office refused to pursue felony charges against the man, citing “insufficient evidence” that he knew that the firearm was stolen, according to a police source.

    Police stopped 23-year-old Tarik D. Coleman outside of Table 52 restaurant around 3:40 a.m. on January 26 because the Mercedes he was riding in had expired plates, according to court records.

    Cops say Coleman removed a Glock 27 .40-caliber handgun from under his seat during the stop.

    Coleman was detained, and police reportedly found a 9-millimeter handgun in the vehicle’s glove compartment.

    “Those guns are mine. The Glock and the nine. I bought them at Cabela’s in Indiana,” Coleman allegedly told police. “Don’t put them on anyone.”

    An investigation found that the 9-millimeter had been reported stolen from Mooresville, Indiana. Coleman changed his story to say that he bought the stolen gun “on the street from some guy in Chicago Heights,” police said.
Bought it on the streets? That would appear to run afoul of 430 ILCS 65/3(a-10) which, if we're reading it correctly, is a felony, though of varying degrees depending on other factors.

And while Possession of a Stolen Firearm is a felony under 720 ILCS 5/16‑16, knowledge (intent) appears to play a role in the charging - though as the offender's story changed from "bought it in Indiana" to bought in "on the street," a halfway decent interrogation might solicit information that he knew it wasn't on the up-and-up.

Too bad Kim Foxxxxxxxxxx isn't a law-and-order type of States Attorney.

Why do Chicago police officers still have to register weapon but every other hack in the City doesn't?

No such thing as a security guard carrying illegal anymore either. These wanna be's are carrying weapons all day even if they don't have a security gig.

Extended magazines dont even call it in just inventory it and kick the goof.

Felons you will get the charge but if it aint in their hands and you don't see it with video it did not happen. Just do a contact card like the guys in 8 and 9 do.

It is only going to get worse with Foxx as SA. She is Preckwinkle's stooge and believes there are entirely too many black people in the county jail. She will very selectively enforce the laws as we have already seen with regard to thefts. It will be the same thing with gun crimes, aggravated batteries, drug crimes, and armed robberies. The types of charges brought will always be the lowest possible included offense. When the case is assigned to a trial courtroom, the assistants there will be instructed to allow the charge to be further reduced for a plea and sentences avoiding incarceration are being encouraged. Foxx's term as SA will be a benefit to every gang banging criminal in Cook County.

If our impotent court system can't do their job - wouldn't ATF be able to charge Coleman? If convicted - a Federal facility several states away would be ideal to serve a real sentence. That could be a real deterrent to our yutes.

Our first three gun cases this year have all been in vehicles and everyone in the vehicle gets rwoc. All three cars had at least three heads and in three of the incidents a/o observed one of the occupants moving around in a manner consistent with hiding contraband in the immediate area where the pistol was recovered. Asa said in all three cases no one confessed to knowledge or said the pistol was theirs so rwoc everyone. They stated they will issue warrants if prints are found on the gun. Funny when atf came to the district and told us isp crime lab only finds prints on CPD recovered guns 10% of the time. Because the department doesn't have proper equipment to properly recover firearms. Isp doesn't even bother looking for prints. With that knowledge some guys in the neighboring district got a confession of a guy in a car with a gun that said the gun wasn't his he just hide it for one of the other occupants in the vehicle his charges were approved. However when he got to the grand jury the Asa told them they were dropping the charges because no one is going to believe that someone would confess to knowledge of a gun in a vehicle with multiple occupants. Get ready for a bloody year Chicago.

I know this is not the focus of the story but who owned the Mercedes? This stupid piece of excrement did not buy a renewal because he could not buy a renewal. The car belonged to someone else? And the moral of the story; the Cook County States Attorney contributes to the proliferation of crime in Chicago. That is not some off the cuff statement, it is a fact. They under charge or no charge, the judges further reduce the effect of crime penalty and the purpose of the law and the citizens are left to deal with crime on the street by sanctioned and emboldened criminals.

It's felony review, are you REALLY surprised? I had a guy not too long ago with fraudulent registration, a BS sticker and every VIN defaced/broken/dremeled off the vehicle. 3 felonies per IVC. Felony Review refused to charge any of them because he didn't admit knowledge that any of it was fake/defaced and that it can't be proven that he did any of it to that car. Da fuq? You can charge everyone in the car with dope or guns if it's found and they want to play stupid. Yet buying fake plates, a fake sticker and driving around in a car with no VIN and no means of tracing anything and that's perfectly acceptable because he didn't say "yes, I bought fake shit, stole a car, destroyed the VIN's and had hope you wouldn't find me!" Cook County is a joke.

Always protect yourselves boys and girls when dealing with guns. Document everything you do when recovering a firearm. Make all notification seeking appropriate charges and make sure to get names of everyone who denies upgraded charges. The only one that gets hurt is the working police.

There's 3 bars that have destroyed Division street: Room 7, Primary, and detention. All thugged out west/south side residents love coming to these bars to destroy the neighborhood. There were three people shot in this area a couple of months ago and most recently the CC sheriff just got shot in the head there as well.

Even though I am recently retired (thank you God), no matter what I will always back blue! Was stopped in the suburbs after retirement for a red light violation, nice copper asked for license etc, told him i was retired CPD we talked took my license and said OK be right back. He was in his car writing for about 10 minutes I thought the "thin blue line was over" he came back and said I have to give you a "warning ticket" as he pointed to the camera on his vest, I said thank you (It meant nothing but (a courtesy)he said we are all blue! Really thinking about it talked to my nephew who was in Iraq in the Marines he said "Uncle a marine is never an ex-marine your a Marine for life" Got me thinking we are Blue for life, maybe that is why when I observe active coppers doing the job I feel ready to assist if anything goes south and anyone attempts to harm my Blue brother/Sister blue for life like the ring to that! god bless my brothers/sisters in law enforcement everywhere!!

This kind of thing is entirely political. Private sales of property are perfectly legal, though the FOID system may not be. They aren't going to pursue charges unless it's a slam dunk for other reasons, because everyone knows NRA is foaming at the mouth to bring a case challenging the FOID card, a state-created barrier to exercising a constitutional right.

Confessions and statements are useless if not recorded. Even when written down they'll argue they were coerced. I'm not even sure why Felony Review approves with statements if they'll just drop it in court.

Just like if dude runs into someones house or porch, or if you even see someone on a porch with a gun. ASA's will ask, "Was he an invitee?" I understand the law but it's kinda silly. Or my favorite, the horribly written law of possession of cannabis while in possession of a handgun but says nothing about being in possession of a controlled substance.

Not the police, but presently I have to live in Chicago proper. Reading this about ASA not enforcing gun laws for a technicality is nuts. Someone should tell this Foxx its not a perfect world and to prosecute law beakers. With the crazies carrying guns and a lack of prosecution, it's time for me to acquire a concealed to carry permit. I have had training in the Marines and guns are nothing new to me. The more of law abiding people carrying a gun will have an effect on this situation that exists on the streets of Chicago and elsewhere.

Can't the street deputy override the ASAor was that power also taken away? It wasn't that long ago when an ASA rejected felony charges , the Watch Commander would call in the street deputy to review the case and override Felony Review..

Like I keep saying, these folks are not prosecuted because only the OBVIOUS will actually stick in court, and those are pleas made so no trial ever even happens in the first place. Lawyers KNOW that Chicago and Cook and State politicians know that the code is precarious and case law has gotten Illinois in general in hot water among the gun control community enough already the last decade or so. Rather than risk more of that, and for racialist purposes too, they just walk em in the in door and out the out door.

Illinois gun law is so focused on the gun, rather than on actual crimes committed WITH THEM and so broad that starting a trial and seeing it through puts gun control nationwide at risk. Opening up standing to light em off is not something they want to do. So they let em walk. That way, the rest of us stay scared and don't carry because it is so treacherous to do so.

Drop the gun control, correct the code- and then even the guys with stolen guns can be hammered by the judiciary- as it should be in the first place. Oh and ahhhh put the grand jury back in the peoples' hands instead of this pathetic "prosecutorial discretion" and that will go along way to resolution too.

Can't the street deputy override the ASAor was that power also taken away? It wasn't that long ago when an ASA rejected felony charges , the Watch Commander would call in the street deputy to review the case and override Felony Review..
WTF, Rahm and Eddie should be all over this..

The poor Chicago Copper trying to do the right
thing in seeking any kind of override will promptly
get it stuck in his/her moon sideways...

Plus the State's Attorney's Office is big on
retaliation. Every case file with your name
on it as arresting officer will be nolle pros,
NPC and shit-canned in general...

Then you wonder why all of a sudden,
you seem to have turned into a Police
Idiot at work as you now can't seem to
do shit right since you tried to do what's
right and JUST in seeking an override.

An override is not a battle worthy of
fighting because of the forces arrayed
against The Policeman.

It's not worth your grief and aggravation
trying to play righteous warrior of one
with this job and the Cook County Court
system.

A Police Intitated override being successful means
someone within the Cook County Court system
was neglectful in doing their job.

They have their "Code of Silence" too...
