"Reshaping" the Office


  • Newly elected Cook County State's Attorney Kim Foxx detailed her plans Monday for shaping the second-largest prosecutor's office in the country, including creating a gun crimes unit and revamping the team that reviews potentially wrongful convictions.

    [...] In an interview with a Chicago Tribune reporter in her corner office on the 32nd floor of a Loop high-rise, Foxx said her office is looking at its authority to investigate police shootings and not wait for months or years while the Independent Police Review Authority completes its investigation.

Having worked with ASA's for decades I can say that the ones that are initially sent out couldn't find nor the difference between their ass and their brains. And some of the political hack supervisors, looking to advance or run for office, are no better.

We are so fucked from every angle. God help the CPD.

Let's wait-and-see what Cook County comes up with. Maybe she is some real Clarence Darrow or F. Lee Bailey who will amaze us and create a real top-notch professional office.

Then again, maybe she might be just another over-promoted, political hack who should NOT be in charge of anything more than the Mr. Coffee in the office.

I reserve judgement. I'll wait-and-see and look at her actual performance on the job.

UNLIKE in the National perspective of the last 8 years where you were called a "Racist", Bigot, or "Misogynist" or whatever, if you even questioned any poor decisions, poor performance, and bad judgement by those who were clearly incompetent or galactically clueless, TODAY is a new day!

People are going to be measured by their competence and actions and held to a professional yardstick. If they "don't measure up" - then they will be called what they should be called - INCOMPETENT and a "poor match for the job."

No more sugar-coated, politically-correct euphemisms.

Incompetence is not a color or race or gender classification. It's not "Racist" to call someone incompetent. IF you think it is - YOU'RE the BIGOTED RACIST.

So if you are going to try to LABEL me and attempt to "Classify"or stereotype me into some segment, you can label me "Professional".

Professional is not a race, gender, or ethnic group. Professionals are those who do their job and do it well.

Just as anyone in any race and/or gender can be designated a Professional, they can also be designated incompetent if they fail at doing a good job.

It's as if most of us didn't even realize that it was happening, but it's pretty clear that we have created a society where anytime a non-black person says anything critical of a black person, it's immediately labeled "RACIST" and everyone in the community and the media piles on and concludes that the non-black person is, in fact, a racist, because a black person said it to be so. "Racist" is quickly becoming one of the most over used and misapplied words in the English language. Let's have a teachable moment, shall we. If Johnny refuses to sit in a room with a black person solely because he has dislike for any person who is black, Johnny is a racist. On the other hand, if Johnny is a citizen that is familiar with criminal justice policy and has half a brain and criticizes Kim Foxx's ideas because he thinks she is taking the wrong approach on criminal justice policy but could care less about her race or gender, Johnny is not a racist or a misogynist. Doesn't mean that Johnny is right in his approach either. Just means that he disagrees with another person. If Kim Foxx or anyone else calls Johnny a racist for disagreeing with Kim Foxx, that person is a racist and a bigot and is likely just an asshole too.

It's a brilliant defensive move for anyone in the black community to keep their racist label maker hair trigger ready. That way they can escape any and all criticism from anyone as they proceed to fuck anything and everything up. It certainly explains by Toni Preckwinkle gets a total pass from the media when, in the name of fiscal responsibility, she raises taxes and fees year after year after year. Who would dare oppose her? The same will be true with the new State's Attorney. And God knows, everyone in that office is scared shitless that if they don't hop aboard the Foxx train of criminal justice dismantlement, they will be dismantled themselves.

Time to move to a state with lower taxes, public safety and better weather. Let the liberals destroy. They can't be stopped at this point.

So in an officer involved shooting it is going to be investigated by the department (or outside agency like State law says ) And COPA. And CCSAO,

All tripping over each other. Interviewing the same witnesses. How do they decide who gets to collect what evidence?

Also if/when the outside department arrive on scene is officer required to speak with them? Would Miranda rights be required?

If ASAP wants to talk, are Miranda rights required?

Does anyone know what the qualifications are for incoming ASA's, and what personal criteria must be met?
Heard a rumor that your interview had to be "sensitive" to the community defendants.
Does that requirement still exist?

I'd be very careful to engage in any of the many ghetto affairs that could potentially lead to loss of some or all of your employment.
Coming before a crooked Cook County prosecutorial system with senile, appointed judiciary is going to be slam dunk for their agenda. If a $1.5 million bond is not excessive while waiting years for a trial on top of legal and living expenses, then go for it, hard charger.

She (Foxx) is horrifically under qualified as a lawyer, beholden Preckwinkle, the machine and its scumbag politicians. ASAs can't investigate their own cases. They can't wear two hats. They cannot investigate and prosecute the same case. If they choose to do so they no longer have prosecutorial immunity. Just ask Marilyn Mosby. The lawsuits filed against her by those officers that were railroaded is based on piercing her immunity.
However, if she passes the case off to another "special prosecutor" she may be able to investigate these cases. My advice, don't say a word and request a lawyer.
For other officers on this blog saying give her chance, you're either very naive or stupid. No way around it.

I am going to publicly reveal what to do if your involved in an incident!First we call agree no matter what we are stressed out, and nervous. Repeat after me "I was afraid of my life" which of course is why we protect #1 at the scene us! Keep repeating that, none of that gold star bullshit "dont worry kid tell me what happened" Obviously your heart is taxed call for an ambulance (at this point no statement is needed" Remember keep repating "I was afraid of my life" That is all you say after saying "I need an ambulance" at the hospital you will be monitored request only family visit no "cool boss" ever! Now this could take a couple of days while you recover, get your lawyer from fop absolutely no one else in room as you discuss what exactly happened! It does not matter what anyone else says, or observed during this moment you have "tunnel vision" what did you see? The less said the better.In the hospital no texting, no looking at texts from other coppers remember they will look into your phone! Eddie may come to see you and the other over promoted yes boss gold star club say nothing in confidence. the only person you trust is the son of a bitch you look at in the mirror otherwise say nothing.

Take this from a recently retired vet who went through hell with this department for 3 years but all turned out ok. Best lesson no matter what shut-up!

One always has the right to say nothing in a CRIMINAL investigation. If the investigators know from the beginning that one will be charged with a crime, they have the obligation to advice one of one's rights. Advising one of one's rights is the beginning of the adversarial process (read charging one with a crime).

The issue for police using deadly force is that the investigation does not usually begin as a criminal investigation but as an administrative one. The investigators, in the past detectives and now IPRA, work from the premise that the officer as an agent of the state is doing his job correctly as the law and general orders prescribe. If that is the case, as certainly is in the overwhelming majority of cases, all is well and the case is adjudicated as, a for lack of a better phrase let's say, "a good shooting."

However, in very few instances, as the administrative phase progresses, the investigators may deem that the shooting in which the officer was involved is not a good shooting. Technically, if the investigators deem the shooting as bad, constitutional rights will attach and it is their obligation to make the officer aware of his/her right to say nothing.

Now the big question is: Should I say nothing if I am involved in police related shooting? The general orders of the department obligate officers to give a statement to the highest ranking officers during the administrative phase of the investigation. This statement is to be given only to the ranking members without witnesses. One is also required to cooperate with IPRA regarding the investigation.

To my knowledge ASAs are not involved in the initial on scene investigation or the immediate follow up IPRA investigation. If you are presented before an ASA during the investigation, I would say it is in your best interest to have a lawyer present.
I am sure some fellows on this here blog will have more to add or correct to the above which hopefully will point you and us in the right direction.

Last year I started to ride with an old timer- carried a bag full of books- and a large coffee thermos- and picked up the newspapers. We went out and parked in an empty parking lot. He put the news radio on- poured us both a cup of coffee and pulled out a book and we stayed parked till we got a call.drove slowly- handled the job- and back to a new empty lot and a new cup of coffee.
I asked what's with the thermos, and parking in empty lots. He said his coffee maker was clean at home- no one peed in it or spit- you can see anyone who comes near you in the lot- and he has two yrs till he retires to Texas. Take some advice kid get a bag full of books, a coffee thermos and get the fuck off this job- all it takes is one call going to shit and they will toss you in jail.Do nothing- don't listen to the propaganda- you may love the job, but the job is a whore and it will never love you back.Best advice I ever got- I 'm leaving , got a job out of state, no more cold winters.

I agree especially bring your own coffee and food. I worked with a copper in 010 back in 1987 I think was the year we went to a restaurant on 22 and troy eat the copper had like 1 year on job felt sick, turned out rushed to hospital ate something tore small hole in stomach artery bled out coded out many pints of blood emergency surgery off work for months came back to work still surviving ok retired. That was way back then when many still liked the police in today's climate trust no one the media has beat it into many of their heads anti-police bias! Bring your lunch not hard to do, or if you want to buy something many stores sell prepackaged food salads etc that way when you buy and eat that if something happens with the food you know it was not meant intentionally for you because of your uniform!

Most working in restaurants work for minimum wages your not getting the best and brightest serving your food,and many are criminals with arrest history's think they are vengeful against police? think again!

Whether an attorney went to John Marshall or Harvard they still have to pass the Bar Exam to practice law here in Illinois . I've met good ASA's over the years . I've also met bad ones . Lawyers are like any other profession , some competent some not . You sound jaded . Have a beer buddy and calm down .
