Send in the Clowns!

You know you've fucked up when you have to send in the commanders:
  • Supe sent the commanders into roll call to explain the reasoning. You know they fucked up when commanders are in roll call at 7am on a Saturday morning trying to play "damage control." Our commander literally said "he seems to be within the parameters of the use of force model but I think the dept in this day and age is in the business trying to keep the community peaceful." So you're flat out admitting that you removed an officer from the street and put him in call back for doing nothing wrong because we need to appease the criminals in the community so they don't riot? HOLY FUCK this city is a joke. That officer needs to get a lawyer and sue the city ASAP. This shit is bullshit.
Not only that, but we have De-Escalante demonstrating he knows ZERO about the Use of Force model:
  • Escalante addressed roll call. He said there was nothing in our use of force model that allows an officer to kick someone in the head.

    What a spineless merit hack.
John must have missed a few Use of Force lessons years back. And forgotten what the Use of Force order said when he took (and supposedly passed) promotional exams. And how the order has been changed recently.

Escalante was addressing roll call at the pr fest when he said that. Half the room started laughing the other half was yelling trying to explain he was a high level assailaint. The second in command can't doesn't even know the use of force model or at least can't tell the difference between a resistor and assailant.

When the head is the only body part available to the officer and the assailant is choking another officer and resisting it's ok to kick the assailant in the head. How much does Escalante make a year to not know that? Using a taser is also justified in that situation but could you imagine what the powers that be would've done if that officer tasered that dude in the head?!

If a commander did say that, look for that commander to receive a phone call to come to 35th street and do some explaining. The law suit to follow will have that commander and every cop at the roll call be ordered for a deposition and to testify during the trial. The brass are their own worst enemy, especially when trying to remove both feet from their mouths.

The cancer of Area North, NAGODE, also was preaching about this poor officer being outside the Use of Force Model. This is another hack who had no idea that we could use a head stun (even by foot) to gain control of an aggravated battery offender. Do the bosses read the General Orders?

Can their attention be directed to General Order 03-02-02, "Force Options", most recently revised in January 2016. IV.C.1.a. Level of Force Response Options Guidelines.....for an "assailant", the following use of force is allowed and advised: "Direct mechanical techniques are hard, concentrating, striking movements such as punching and KICKING [emphasis added], or powerful locks and pressures. These techniques can be combined with take-downs or pins against the ground or other objects." This is straight from the General Orders.

So what now are the options for the officer when he is "stripped of his police powers" for following the General Orders?? Must an officer suffer the indignation of "being stripped" in the eyes of family, loved ones, and friends, because the criminals might get upset?? Sorry if it doesn't "look good" in the media, but guess what, we are the police. Sometimes our work is not pretty. Don't let the public who are uneducated and inexperienced in the intricacies and nuances of police work dictate how police work is done. Stand up at the podium and tell the truth about what we can and cannot do:

Again, from the General Order which quotes the LAW from the Illinois Compiled Statutes:

(720 ILCS 5/7-5) (from Ch. 38, par. 7-5)
Sec. 7-5. Peace officer's use of force in making arrest. (a) A peace officer, or any person whom he has summoned or directed to assist him, need not retreat or desist from efforts to make a lawful arrest because of resistance or threatened resistance to the arrest. He is justified in the use of any force which he reasonably believes to be necessary to effect the arrest and of any force which he reasonably believes to be necessary to defend himself or another from bodily harm while making the arrest. However, he is justified in using force likely to cause death or great bodily harm only when he reasonably believes that such force is necessary to prevent death or great bodily harm to himself or such other person, or when he reasonably believes both that:
(1) Such force is necessary to prevent the arrest from being defeated by resistance or escape; and
(2) The person to be arrested has committed or attempted a forcible felony which involves the infliction or threatened infliction of great bodily harm or is attempting to escape by use of a deadly weapon, or otherwise indicates that he will endanger human life or inflict great bodily harm unless arrested without delay.
(b) A peace officer making an arrest pursuant to an invalid warrant is justified in the use of any force which he would be justified in using if the warrant were valid, unless he knows that the warrant is invalid.

It's just shameful. Hold officers to a standard that none of them can come close to.

We have another one on the Trib front page now of some crime fighter punching some shit head who was "publicly intoxicated". Publicly Intoxicated? Your going to risk your job and freedom over some shitbird who is drunk in his own 'hood?

Of course this was a plain clothes officer, one of those Japanese soldiers left on the Island 60 years after the war. And no matter what the facts are the real truth is it was only for public intoxication, it was in some shit neighborhood that doesnt care about it, and its some copper punching a downed offender about five times so hard you can hear fist smacking meat.

Let me put a slightly different spin on this whole issue and some others. First there is a lot of talk among many of you about filing a lawsuit. Try to remember that in order to collect in a suit you must have some damages that can be rectified monetarily. Being stripped while not losing any pay or benefits would not qualify. Perhaps Johnson is telling the truth that he stripped and assigned to Officer to desk duty to protect him. Consider this, he is obviously an aggressive type, he goes out in another day or two and has another similar incident. Where does that leave him. Maybe inside, wherever he is, is the best place until this whole thing is over. Many of you probably know that this is standard procedure in many departments. In any controversial actions, officers are routinely assigned to desk duties pending the investigation. That policy protects the individual Officer and the department.

There is nobody in the district that can speak up for you, especially on third and first watch, because you never were in patrol with us any longer than you absolutely had to be. Frankly, most of you don't have the first clue about how modern street policing works because you have never had to wear the blue and answer calls in a fast district while people record you understanding that there is nothing better out there for you because you are not connected. You've never condescended to speak to someone who has been there because there was nothing in it for you. Your kind has sucked the city dry and have pushed things too far. You took every thing from the job that was there and destroyed any illusion we in patrol had that we could get someplace on our own merit. Then you still wanted work. And many did it because the had convictions that they were helping the community they worked in. A quiet dignity that they were doing something important even if it wasn't recognized. (A joke to you bosses.) You used to have the carrot and the stick but you sold the carrot. Now you only have the stick and the mule knows he'll get it no matter what he does. The only thing you can do is follow the legitimacy training that you exempted yourself from, and try to rebuild the relationship. Take less, support more, do the job you have well and stop waisting time maneuvering for next one up the ladder. And use district and department budgets for the equipment you need instead of slushing it. Stop stealing from the flower fund and the Christmas party fund( I want a chair at roll call made after Carter was in office!)Give people their time off. They earned it. Stop thinking of patrolman as "These Jagoffs!" If your own personnel don't trust you, how can the community they work in. The numbers you demanded are the numbers the ACLU used to hang us. Those fucking contact cards that made your career did this. I know you are scared and it is an uncertain time. It's also exhilarating because, if someone at the top is pulled down maybe you got a shot at commander if your chinaman replaces him. (Wouldn't that be great!) Now I know the justice department has to be gone before the next president is sworn into office since the current president's ex-chief-of-staff is the mayor of the town being investigated, but that's not the end. If we're universally miserable and worried about our liberty and livelihood being taken we won't have any reason not to call off work when we are sick or hurt. (My elbow has been fucked up for a week. I haven called off as is my contractual right. If I have a bad cold I don't call in either.) Horrible conditions uniting workers were what formed unions. Think on it.

Even the commanders are attending role call to explain the actions of the supernintendo. Don't believe the hype! This department doesn't have your back, will not have your back and rarely did so in the past 5-10 yrs. At least one commander expresses self-preservation by stating know the use of force policy, be able to articulate it both verbally/written for testifying. You and your partner go home with the same amount of holes(uninjured) and if you have to do an ISR, do it by all means as to not jeopardize your family's income, pension and do jail time. It's a shit show here.....

I worked a beat car my whole career and never had the need for more.I did get asked if I wanted to go to the old SOS by one of the bosses but I politely declined.If there's a demand to bring in a certain number of heads it's just not worth it.Reconsider where you are going on this job. There's a life waiting for you IF you retire.

I taught the Use of Force Model for many years. It allows the officer to defeat any resistance during a lawful arrest. The officer is not required to first sustain injury before using the accelerated techniques, nor does he have to follow the "officer response" in rank order. If the resistance attains the level of fighting for one's life during a confrontation, the officer can use anything, even a garbage can, to gain control in order to stop the offender's resistance. (720 ILCS 5/7-5) (from Ch. 38, par. 7-5)
Sec. 7-5. Peace officer's use of force in making arrest. (a) A peace officer, or any person whom he has summoned or directed to assist him, need not retreat or desist from efforts to make a lawful arrest because of resistance or threatened resistance to the arrest. He is justified in the use of any force which he reasonably believes to be necessary to effect the arrest and of any force which he reasonably believes to be necessary to defend himself or another from bodily harm while making the arrest. However, he is justified in using force likely to cause death or great bodily harm only when he reasonably believes that such force is necessary to prevent death or great bodily harm to himself or such other person, or when he reasonably believes both that:
(1) Such force is necessary to prevent the arrest from being defeated by resistance or escape; and
(2) The person to be arrested has committed or attempted a forcible felony which involves the infliction or threatened infliction of great bodily harm or is attempting to escape by use of a deadly weapon, or otherwise indicates that he will endanger human life or inflict great bodily harm unless arrested without delay.
(b) A peace officer making an arrest pursuant to an invalid warrant is justified in the use of any force which he would be justified in using if the warrant were valid, unless he knows that the warrant is invalid.

Being stripped while not losing any pay or benefits would not qualify. Perhaps Johnson is telling the truth that he stripped and assigned to Officer to desk duty to protect him. Consider this, he is obviously an aggressive type, he goes out in another day or two and has another similar incident. Where does that leave him. Maybe inside, wherever he is, is the best place until this whole thing is over. Many of you probably know that this is standard procedure in many departments. In any controversial actions, officers are routinely assigned to desk duties pending the investigation. That policy protects the individual Officer and the department.

Grew up here, seen plenty, and I can tell you that black officers are often much tougher on black offenders. They are down with it, know the language and the games, and you can't race-card them. Even the very best white officers have a little steeper "learning curve;" it's just natural. "Privilege," hell, white ofc. are often harder on white offenders, it's this unconscious thing of "We expect better from you and you're f__ing up." Some of the best and kindest officers I've encountered have been black, and some of the worst deserve-a-kick-in-the-head-themselves dogs have been white.

Hey, big city, big department, takes all kinds of people, it's just the way the street shakes down.

Of course it's a little different today, with everybody now justifiably afraid to do their job right -- with violent street criminals getting bronze memorial plaques set into the public sidewalk by a municipality. (Ferguson...)

A stripped officer can't carry, right? So, being stripped effectively limits an officer's ability to undertake or continue in armed secondary employment. That's a loss of income right there.
And a certain female lieutenant, who retired as a captain, was transferred out of a/5 and sent to a district. She lost no income or rank, but her complaint spoke to a loss of standing and she was reinstated in a/5, with a financial settlement.
So, yes. I can see a lawsuit succeeding for those trapped in callback hell.
(And YOU sound like the placating voice of a City Hall intern with orders to find a way to make the officers who are victimized by this policy stand down.)

I agree that the deadly force rule has not changed. What has changed is the perception in the community, media and some (democratic) political circles as to the use of force. Any use force is thought of as bad justified or not. Sadly, that is the new reality.

The officer would suffer no ill effect in his personnel jacket and future career opportunities and the command staff wouldn't eat crow and spin the collective uniform body's moral into a dumpster fire. This also prevents anything remotely close to coming back in 2 or 3 days and doing the same. Any action can't be predicted, Officer involved shootings, car accidents, use of force or just complaints about professional standards. To not put an officer back out on the job after he has been vetted is lunacy on the part of the agency and simply put makes no sense. If civil liability was your main concern then leadership is not your calling.)

Calling community activists and advising them of action that you took before any investigation is also not the norm. It's obvious that you love your agency. It's also obvious that you don't see the bigger picture. This isn't just about this officer. It is about all law enforcement across the US. We must use this case as a shining example of why we shouldn't be served up as sacrificial lambs just to appease the blood thirsty, race baiting media {See The Pinellas County Sheriff Bob Gualtieri response to this tactic by the media on April 22, 2016. Doesn't matter who the superintendent is, he/she will directly take orders and make moves given by rahm. A CPD superintendent will never be their own person, when they make a move it comes from city hall, when they make an order it is from city hall, the CPD is definitely not even partially independent of city hall!
