FOP Sues Over CR List

  • The union representing Chicago’s rank-and-file police officers has filed an injunction against the city and police department, asking a judge to halt the city from turning over records of police misconduct to the Sun-Times and Chicago Tribune until the records can be reviewed.

    The motion for injunctive relief was filed Tuesday in Cook County Circuit Court.

    On Thursday, the city notified the Fraternal Order of Police that lists “‘containing information related to complaints lodged against officers’ covering the time period between January 1, 1967 to the present” would be released to reporters from the two newspapers on Oct. 31, according to the filing.

    However, the union argues that the most recent collective bargaining agreement precludes the city from turning over any such records because they should have been destroyed after no more than seven years.
This should have been on the radar months ago when these lists began to be released. Not Sustained, Unfounded and Exonerated should be or should have been wiped clean years ago. We can understand Sustained cases being contained in personnel files - those cover our entire careers. Once your career is over, there ought to be a sunset provision for destroying even the Sustained cases. And when you pass on to your heavenly reward (or eternal damnation), the files ought to be deleted, too.

I hope they are successful, but I would not hold my breath. The police have no friends in the civil court system or the political system . Not in this state for sure but not in many other states as well.

I am going to find a lawyer and sue the FOP and/or Dan Herbert. Watch and see these fucks gave the Sun Times a not sustained non abuse CR file from 2003. I was not on the CR list and the time frame does not meet the court ordered period allowed and now these gucks go to court for an injunction.

Get a copy of the Personnel Records Act.
You'll find that the city and the media violated the
rights of every officer on that cr list.
That Bond v Utreras case will not shield the city or media from liability. There is no reason to indefinitely keep cr records unless of serious criminal nature.
The named officers are going to prevail in long run

I don't know if the P.O.'s are aware of this, but I would like to tell you how tilted and unfair this system is. Let m e start by saying this, I am a Sgt. and have only been one a short time, however I have investigated a number of CR's which have all been bullshit and I have been able to get rid of all of them so far. The problem I have is when the complainant signs the letter of declination the CR investigation should stop there, well let mw tell you this it does not. IAD and or IPRA want us to identify the Officer(s) involved, even though the number is dead. Now you say that's no big deal because they signed the letter, the issue becomes that you are identified and when these scumbag lawyers file a FOIA request they get your dead CR number with your name attached and they put you in the paper with the rest of the Officers. This needs to change, I have asked my Command staff and all they can tell me is that's how they want it (meaning IAD), that's a great answer because IAD can't answer it either. This needs to be brought to the attention of the FOP, I was on the lists that came out and I will be on the new list as well. Does it bother me, yes and no, yes because normal people in the neighborhood who aren't the Police may look at us like some rogue Cops, and no because we all know they are bullshit. The bottom line is when these complainants sign the declination letter or fail to sign the affidavit the number should die right there naming no one, but it doesn't, it names us which is hardly fair.

This is something they should have had a part of the contract since the inception of the 5 (7) year limit..The contract does not say destroy..And everyone has always known the courts get EVERY complaint made against you whether unfounded, no affidavit, etc....when you are sued civilly. Yet, they have done nothing to stop it....

You don't understand - the contract prevents the use of disciplinary files in determining new penalties, it doesn't require that the city destroy older files.

Ot.... today in 012 I got to watch the crossing guard supervisor come in a late and leave early. Not only her but I watched one of the three time keepers doing the same thing. And let's not forget the intelligence officer coming in at 10 and leaving only after 3 hours of work. So contact cards not happening from me. Screw it. Y not hold one of these people accountable. Makes me sick after 20 years on this job to see 012 even worse now then it was before the merger. And to boot all these officers mentioned I love to see how many hours they have on the books. Cuz I no my time gets taken.

I am the ppo who asked "how do you cope with the negative, depressing, etc. scenes we see at work on a daily basis? I work in a busy district. I asked my fto and others and I received smart allick replies. GFY! I posted on this website and I received a lot of good advice. I want to thank you for your insights. I also found some officers at work who are helping me. That in itself is a relief. I approached my sgt. who is an easy going boss. He hooked me up with some other officers and by talking to them and learning how to cope with the emotional indignities of this job has helped.

To anyone who is in my boat, speak up and find experienced officers you can talk to. It helps out a lot. Don't listen to the negative coworkers.

It is doubtful if the requesters of these records are old enough to have been around/have a point of reference from which they can make sound and unprejudiced judgement on what they hope to see.

It is also doubtful if the requesters have the native savvy and insight to "put it all together." it is perfectly clear that they have an agenda to hurt the people whom the vast majority thereof, served honorably and to the best of their ability as Chicago Policemen.

They want to judge past Policing practice by current rules of engagement and the current culture of liberal agenda driven political correctness coupled with the prevailing attitude of a trophy and ice cream for everybody because they thought The Cops were mean.

We think it was Leroy Martin, as big a buffoon he was, who said something along the lines of Policemen not being from Mars.

Stop complaining. I work in the academy and it is worse at the academy. At least in 012, they are showing up for three hours. The privileged people at the academy get free days off. We do not have that many recruits going through the academy. Many people are doing absolutely no work at all.

The Sun-Times, The Chicago Daily News, The Chicago Tribune and even Chicago Today used to run "Surrender or Die!" or similar such banners directed toward criminals who committed outrageous acts.

Let a publishing staff even entertain the notion of doing that in this politically correct, war against the police era.

It's easier and much less politically bloody to vilify cops.

Coppers are pretty much constrained from fighting back and exacting wholesale revenge against those pushing this slanted anti-police agenda.

Your individual and collective good names, good deeds and sacrifices have come to mean nothing now and the powers that be demand that you smile and laugh it all off or the public will think of you as greedy and selfish.

I had a multiple count CR accusing me of multiple felonies. Confidential Investigation went on for almost two years before I found out and was called in for statement etc.

The end result was Jody Weiss signed off on all counts of the accusations be Unfounded and Exonerated. No Not Sustained. Unfounded and Exonerated.

Then I sued the accuser and found out how full of shit the affidavit law really is. Coppers think they are protected from false accusations. Bullshit. The accusers still lie and sign the affidavit. Big deal, they lie, hard to prove and Anita Alvarez won't charge them.

And that is going to get released to the newspapers? Total bullshit that sounds like I am a serious felon. I can just imagine Frank Main or someone trying to make a case out of it. The accuser is still a wacko and will very likely still spout the same bullshit. And I have been retired for several years.

At least I can thank Jody Weiss for making it Unfounded and Exonerated.

Ray sounded like an idiot when I asked him about the recurrence section of the proposed contract and to explain the tiers.

In his soft spoken, I don't have a fuckin clue voice he tried to explain it to us but had to stop, think and start over a few times.

This isn't the FF union where you have to stop, drop and roll when things get hot.

It's easy, explain to coppers what you negotiated in the contract. Ray supposedly handles medical, right? He negotiated the medical/IOD part of the contract, right?

This is the idiot crew that we have on this issue? Please. We're screwed.

And let's not forget the intelligence officer coming in at 10 and leaving only after 3 hours of work. So contact cards not happening from me. Screw it. Y not hold one of these people accountable. Makes me sick after 20 years on this job to see 012 even worse now then it was before the merger. And to boot all these officers mentioned I love to see how many hours they have on the books. I was at FOP a few weeks ago and one of the girls was asked if she took a lunch yet and she responded "I havnt taken a lunch in months because no one is ever here."

I told her everyone has to take a lunch. She said no one is there if she did to take medical calls. She acted like it was no big deal.

The girl who sat next to her chimed in and said she too hasn't been taking a lunch. Wtf is going on at fop where these girls are covering for the officers in office because they're never there and they can't even take a lunch?

These guys make 6 figures a year and those girls I'm sure make no where close to them but they seem to run fop.

When I was a Sgt I spent time up in 20, talk about dog asses, they should have a special award for this fine group, among them was a PO. who got caught in a criminal act, charged but beat the case, even after video footage of him stealing from a cash register on a burglary call, they then sent him right back to 20 where he was a joke, other sgts let him do what he wanted, foot men leaving early, the girls on the desk would do their nails, read books and bitch when they had to do a report for a walk in. Coppers up there would do anything not to write a parker let alone a mover. I'm sure it has improved by now, but I was so happy to get out of that hole.

I voted for Dougherty. He's a great guy and wouldn't have sold us out like Dean did. Dougherty had so much knowledge and experience and he fought for us over the years on everything but that's why the city hated him. Dean would rather blame the prior administration and shake hands with the City. That's not a fighter that's a sellout and a man with no backbone.
